    It’s not very often that the lowly taxpayer gets a win this big, but it finally came. After 12 years of wrangling over toll roads, Governor Greg Abbott and Lt. Governor Dan Patrick came to the rescue issuing a final decree ending toll roads in Texas. The Texas Department of Transportation (TxDOT) ignited a taxpayer revolt when it proposed 15 new toll projects as part of the update to its ten year plan — the Unified Transportation Plan (UTP). Not only did TxDOT try to railroad a litany of toll projects, it adopted a plan to use Prop 1 and Prop 7 funds that are constitutionally protected from going to toll projects to finance the US 183 toll project in Austin.

    Abbott campaigned on the promise of fixing Texas roads without raising taxes, fees, debt or tolls. He reiterated his position in his first State of the State address in 2015 as well as when he announced his Texas Clear Lanes initiative that was to focus funding on the state’s most congested roads.

    Most legislators receive failing grade on anti-toll Report Card
     Both bills filed and bills that moved meant bad news for taxpayers, drivers Austin, Texas - Anti-toll watchdog group Texans Uniting for Reform and Freedom (TURF) released its Report Card from the 86th Legislature today. In comparison to the prior session in 2017, where 57% of legislators were considered friendly, in 2019, that number fell to just 19% (based on the number of lawmakers who earned 'A's & 'B's). TURF used 18 different transportation, property rights, and good government bills (that impact those first two issues) to calculate each legislator's score, all of which are listed at the end of its Report Card. Every lawmaker was informed of TURF's position on the bill prior to the vote. 

    The Texas House went off a cliff in terms of friendly legislators, with 73% earning a failing grade. In the Texas Senate, taxpayers fared much better with 45% of senators earning As & Bs. Just 16 total lawmakers earned an 'A.' Compare that to 56 lawmakers in 2017, and anti-toll voters have cause for concern.

    "While none of our anti-toll reform bills ever got a vote either in committee or on the floor this session, the bills that did move were a disaster for taxpayers. The House Transportation Committee, including most every Republican, clearly wanted to raise your taxes on driving with six bills to increase fines & fees whether registration fees, local sales tax, or traffic fines in 'safety corridors,'" points out TURF Founder/Director Terri Hall.

    Lone Star Rail resurrected by link to I-35 toll lane debacle

    The saying that two things are inevitable — death and taxes — just got expanded to three things: death, taxes, and government boondoggles that never die. Yesterday, the day after the Alamo Area Metropolitan Planning Organization (AAMPO) unanimously rejected funding further study of the Lone Star Rail which was on the heels of the Capitol Area Metropolitan Planning Organization (CAMPO) pulling its funding, the Bexar County Commissioners Court passed a resolution to transfer the Lone Star Rail environmental study from the Lone Star Rail District to the Texas Department of Transportation (TxDOT). So now, not only will every Texan’s state gasoline taxes be paying for this rail boondoggle at the state level, the resolution also called for moving the rail corridor over to Interstate-35, despite the Texas GOP platform's plank opposing rail.

    The Lone Star Rail project envisions a 77-mile commuter rail between Austin and San Antonio, and it’s been studied since the creation of the Lone Star Rail District by the Texas Legislature in 1997. Over $20 million in taxpayer funds have already been spent on studying the feasibility of the corridor, and the price tag is somewhere between $2-$3 billion (that’s a big range). Union Pacific announced in February it would not allow the rail project to utilize its tracks. The feds passed on granting the project federal funding. Then the Chair of CAMPO, Will Conley, decided enough is enough and led the charge to have the board vote to defund the project August 8, leading all to believe it was the death knell for the Lone Star Rail.

    Here we go again! Another toll road expansion gets to hopscotch ahead of the state’s major congestion priorities such as I-35 in Austin, Dallas, and San Antonio. The Texas Transportation Commission just approved spending $36.7 million in toll revenues to add another toll lane to the state operated section of SH 130 from SH 45N to Hwy 290 (the southern 41 miles is operated by a private corporation that emerged the winner in bankruptcy courtdespite the promise it would return to the public if it went bankrupt).  More broken bureaucratic promises – shocking, right?

    Buried in the commission agenda was a nebulous, generalized agenda item 3(a): ‘The construction of highways and other transportation facilities’ (see attached itemized list). After searching through 21 pages of projects, the Commission expects the public to discern what’s going on when it gives no project description and merely lists how much money the Commission is approving for each project. The word ‘toll’ is nowhere to be found, unlike past Commission agendas that clearly delineate toll projects under separate agenda items and have a specific minute order with detailed information about the project and the origin of the funds.

    Anti-toll groups ask Abbott to suspend tolls, penalties during crisis



    (March 30, 2020 — Austin, Texas) Today, Texans for Toll-free Highways and Texans Uniting for Reform and Freedom (TURF) call on Governor Greg Abbott to suspend the collection of tolls during the state of emergency due to the COVID-19 crisis. Abbott has already suspended penalties for late vehicle registrations and drivers license renewals during the COVID-19 state of emergency, and the Texas Supreme Court has blocked residents from being evicted from their homes. In addition, power companies and public utilities have been blocked from shutting off power and water to homes during the crisis. So the anti-toll groups contend the same should be granted to drivers with unpaid toll bills so people don’t have their vehicles impounded and lose their ability to get to work.

    The groups are asking the Governor to:
    1) Suspend tolls during the state of emergency.
    2) Suspend the imposition of fines and criminal penalties for unpaid toll bills (which includes fines, blocking one’s vehicle registration, and impounding vehicles).

    Suspending tolls, fines, and criminal penalties will expedite the ability of trucks and essential workers to get goods and people to where they need to be using the fastest possible route. Many healthcare workers cannot work if they have a criminal record. Since an unpaid toll bill is considered a criminal misdemeanor (Section 372.110(b), 372.111, 372.112, see here) in Texas, this imperils healthcare workers’ ability to stay on the job in some health systems.

    “This is not the time for state or local toll authorities to impose criminal misdemeanor charges against people with unpaid toll bills. A misdemeanor can prevent healthcare workers from keeping their jobs and possibly other essential workers like truckers and emergency responders. We cannot afford to lose any of our essential workers during a public health crisis,” advocates Terri Hall, Founder/Director of TURF and Texans for Toll-free Highways.

    "With the financial stress of many workers losing their jobs and families facing uncertain financial situations, having an unpaid toll bill that piles on penalties and late fees during this state of emergency and public health crisis is unreasonable, especially when work restrictions are in place,” Hall points out.

    Lawmakers clash with toll bureaucracies over cap on toll fines

    It’s a great day for Texas drivers as a new law takes effect capping the toll fines and fees on some Texas tollways to $48 a year. Texas Attorney General Ken Paxton issued an opinion just as the law took effect that said the new law applies to all toll entities, but only under a limited section of the Transportation Code — Chapter 228. This has put toll agencies, like the Texas Department of Transportation (TxDOT), on a collision course with lawmakers over the interpretation of how broadly the law impacts certain toll projects.

    Paxton did assert the new law applies to “an entity operating a toll lane pursuant to Section 228.007(b), Transportation Code,” which brings in every type of toll entity. However, most toll projects are not governed by agreements with TxDOT under Chapter 228, so toll bureaucracies argue the new law, passed as part of SB 312 last year, only applies to a handful of toll projects.

    Out of control: Commuters clobbered with $44 one way in tolls

    Tolls hit $44 one way to go 10 miles on Interstate 66 in Virginia. Rub your eyes and read that again. Tolls have become the new ‘drug’ of choice for politicians and bureaucrats. It’s become a legalized form of highway robbery. While elected officials try to navigate the mess they’ve made by unleashing unelected transportation bureaucrats with the unfettered power to enter into secret contracts with foreign corporations behind closed doors and giving them carte blanche access to commuters wallets with virtually no limit, it’s no wonder toll rates have reached unsustainable levels in a few short years after state lawmakers embarked on the grand toll experiment.

    With little checks and balances, commuters are now locked into congestion misery or face financial hardship the likes of which have never been seen in America simply to get to work. For many, working will no longer pay the cost of getting there. It’s not just I-66, but also interstates 95, 395, and 495. Express toll lanes, often referred to as ‘managed’ lanes, are the new normal in many metropolitan areas, especially in states that jumped on board early due to the influence of Bob Poole and the Reason Foundation — like Florida, Texas, and Virginia.
